    The local San Diego USCIS office suggests that certain remedies may be available for military families facing the problem of ineligibility to adjust status because of unlawful entry by a family member seeking adjustment of status. Most often the situation occurs when a United States citizen service member�s spouse entered without inspection and thus cannot adjust status. Current way to fix the status is via Ciudad Juarez waiver process (I-601 waiver application (http://www.visalawyerblog.com/2008/07/san_diego_immigration_attorney_4.html)).

    One potential remedy is �Parole in Place,� where the District Director in San Diego, Mr. Paul Pierre, can parole the alien, who then will be eligible to adjust status. Paroling only cures the issue of admission or parole under INA � 245, not other inadmissibility issues. To seek Parole in Place, address the request to Mr. Pierre. Include the following:

    1. Form I-131 (but it does not need to be paid for when applying)
    2. Evidence of impending deployment
    3. Proof of relationship of alien to the United States citizen service member
    4. Evidence of hardship to the service member and how the situation affects the service member�s �readiness� to perform his or her mission in defense of the United States.

    USCIS also has a program where I-601's will be adjudicated at the United States Consulate in Ciudad Juarez at the time of an immigrant visa interview for the relatives of service members. Mr. Pierre also has the authority to grant Deferred Action. (Regarding issues of admission for adjustment of status purposes, read Sum v. Holder, 602 F.3d 1092 (9th Cir. 2010).)     I had a hard time to get dates in Punjabi for my parents...after trying for many days...finally found some one paid him Rs XXXX and got the desired date time within 1 hour. This is not the right way but I had no other option.

    I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
    Btw, am not sure of the reason for RFE yet.

    Has anyone had their 485 approved with an RFE pending on EAD or AP?

    Hi

    I am Technical Director and have been working in the US under o1 visa for 2 years

    This visa has initially been sponsored by a company, so I can only work for this company

    A lawyer told me that I could self-sponsor another o1 and then be able to work for as much company I want. I have an agent but he is not able to guarantee full time employment.

    So I am wondering if I should do that or not.. What are the exact salary requirements for a self-sponsored o1?

    I got a good folder, awards, recommendations and publications.

    Iam in a similar situation as Ihitha. Iam planning to go to Chennai in June for stamping. Which answer do you think would be a convincing one for that question asked by the VO ?

    Also after changing from L1 to H1, i had my H1 transferred between 3 companies (i changed jobs within a span of 1 month), and the current employer iam working for, iam working for about 1 year and 3 months. When i go for stamping, would they be asking for paystubs from those two companies, or does it matter only with the latest company iam working for ?
    It wouldd be great if someone can help me with some suggestions.

    The American Immigration Lawyers Association (AILA) has applauded the brainstorm of ideas in a draft memo from the United States Citizenship and Immigration Services (USCIS). The now-public draft, leaked without the permission of USCIS, examines the legal framework of immigration and explores possible solutions. AILA commends this reflection of the pursuit of the rule of law and the willingness of USCIS leadership to take up this thorough examination.

    "We have in the past seen many attempts to scour the law to find justification for draconian, and ultimately unhelpful, ways to make immigrants' lives miserable," said AILA president David Leopold. "This draft document tries to think through ways to make the legal immigration system work in support of sensible law enforcement. It respects the law and respects the people who must deal with the law. For that, the administration is to be congratulated, even if none of the proposals is ever carried out." He added that many of these proposals should be carried out. Long-needed regulations to help children and crime victims caught in the system should be published. Men and women fighting for America in the U.S. military should have the comfort of knowing that their families are safe from being deported. Immigration policies that encourage investment in America and creation of jobs should be emphasized and expanded. These are but a few of several excellent proposals in this document.

    "We will never effectively address illegal immigration until we develop a legal immigration system that actually works and that offers people a realistic alternative to illegality," added AILA Executive Director Crystal Williams. "Congress has thus far refused to act. Administration officials at least are trying to find ways to help fill this vacuum," Williams stated.

    Senate Floor to Start Debating the Emergency Iraq War Supplemental Spending Bill This Morning

    As reported earlier, the immigrant community has a huge stake at this bill because of the immigration bill amendments attached to this bill by the Senate Appropriations Committee. The Democratic leadership intends to push this legislative bill and pass it before they go into a Memorial holiday break. There are two challenges ahead for this legislation. One is the right wing Republican Senators who declared their plan to engage in a cat-and-dog fight against this bill, particularly AgJOBS bill of Senator Feinstein which they consider an amnesty bill. The drama of confrontation between the Democratic majority and the Republican minority will unfold in the form of cloture motion to be pushed by the Democrats and the Repulicans attempt to block the motion and to introduce amendments to kill the controvertial amendments. We do not know how Sen. Ted Kennedy's hospitalization will affect in the drama. As people know it, Sen. Kennedy is diagnosed with a brain tumor and his availability in the Senate floor activities remains open at this point. Aside from this challenge, there is another challenge ahead on the other side in the Beltway. It is the White House. Reportedly, President Bush has expressed his intention to veto this bill because of the conditions attached to this bill on the Iraq War. We should hold breath for the next 10 days to watch how all of the drama will unfold and in what way, the curtain will pull down.

    Hello Freinds,

    I came to India on a vacation and went for a H1 stamping on 29th Dec at the Chennai consulate. I ended up getting the famous Pink 221G (Additional Admin Processing - AAP). I believe it is because of my muslim name (I am not a consultant or working for any consulting firm, full time employee with my comp's IT department, work for a reputed manufacturing company and done MS here in USA, been in USA for 9 years now, had previous F1, and H1 stampings).

    The VO asked very basic questions (who is the employer, what they do, where did you go to school, what majors) and didn't take any of my documents except the D156, D157 & Employee letter. She said my visa is approved, however I will have to go through AAP and will have to wait for 4 to 12 weeks.

    I am planning to wait till the end of January and if nothing moves ahead in my case, then go back to USA on Advance Parole (Based on the experience from other members who were stuck in 221G and who travelled back on AP), and come back to India once the 221G is cleared, and the consulate requests to send Passport.

    One of my personal concerns about this approach, does the consulate consider my visa applicaton abondoned if they find out that I have already entered US (using AP)? and will it have any issues in the future with my pending AOS?

    Has anyone gone through this similar situation (that they travelled on AP while H1 is in 221G status) and got successful stamping after the consulate has requested to send the Passport.

    Anyone please share your experience in the above situation........

    Also if am returning to USA on AP, do I have to show the I797, so the Immigration officer puts the expiration date on the I94 as the date on the I797

    Any suggestions will be greatly appreciated.

    Don't be afraid of the "G" lenses. I have several "Pro G" lenses and they are fantastic. The only difference in the "G" lens is it does not have an aperture ring and you don't need that unless you are using the lens on a manual camera. You can set the aperture manually in your D70 through the camera settings and you just don't need the ring.

    Nikon manufactures several different quality levels of lenses and the more the lens cost the better the quality. I suggest that you buy the best glass your budget will allow and you can upgrade later. That's what I did.

    I have the Nikkor 70-300 f4-5.6D ED AF Zoom and for the money it's a good lens. It's a consumer lens and doesn't have the build quality of my Nikkor 70-200 F2.8G AF-S VR IF ED Pro lens. But it works just fine and doesn't cost any where near what a Pro lens cost.
