You may as well ask uscis to ask for the remainder of the H1B period provided there is an employer who is willing to process your H1B. Remember, you will have to lose your current I485 processing and start all the way from scratch though you can recapture the priority date with the new GC process.

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Don't panic. It will be alright you can resubmit the correct fee you have 30 days to do that. Sometimes USCIS can make mistakes even you submitted correct fee.

My situation is like this:
I have 3 months left in my 6th year of H1B. LC and I-140 got approved and presently my employer has filed for an extension of H1B for 3 years.
Once I get the 3-year extension, can I change jobs? I understand that my GC process resets, and I am ok with that. I am planning to get the H1B (valid for another 3 years) transferred to the new employer and would join them only after they get the I-797 (with 3 year validity)
If my present employer revokes I-140, can I legally stay in the country on the 3-yr H1B (new employer)? Or do I lose my status and have to immediately exit the country? I am not worried about retaining my PD.
Could you pls share your experiences in this and I would request suggestion on this. Request your help.

We don't want to waste our golden years of life waiting for law to change, so we can get EAD or GC to start business here in USA.
I have very good business idea where there is huge potential to make it big. My 6th year H1 expires in Feb 2011. PERM recruitment is going on, but my heart is leaning towards starting the business.
So, we decided to take Entrepreneur Federal Immigration to Canada. We are not yet ready to move to India. My case certainly needs consultation (most likely processing) from Immigration Attorney for Canada.
I was looking at Canadavisa.com, but looking for more options. Can anyone recommend other attorneys?
My business idea doesn't require $500,000 investment to target investor visa in USA.

If the employer is not willing to share your I-140 approval status with you, is there a way to find out this information from other sources?
I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.

I just joined a new company and would like to use AC21 as I will be working on EAD. 140 is approved and 485 is pending for more than 180 days. New job is same or similar as per ONET job code.
My question is,
Is it necessary to involve your attorney or you can simply go ahead and file AC21 yourself?
I would like to what others have done? What kind of extra fees your attorney has charged for AC21?

There is nothing called AC21 filing ie AC21 does not have a form that you fill out etc.... generally Attorneys attach the docs with a covering letter citing the AC21 clause and from what I understand, these docs may/may not get into your file.
The advantage of using an Attorney is,
(1) G28 filing - Attorney will get communication and be in position to respond or guide appropriately
(2) NOID, RFE and denials might happen and MTR may have to be filed.
Most times, issues arise when old employer withdraws the 140 petition.
USCIS needs to have a better way of handling this and avoid unnecessary tensions and errors
