There was this news in early May that USCIS is planning to halt concurrent filing and introduce new Pre-App process. So I wanted to learn more about this from others...

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.

Just curious to know whether anybody received the physical card with out a CPO email or status. Did anybody with just "Welcome" email and status receive cards yet?
Just checking whether NO CPO status/ email = no card.
I received the "Welcome" email, status and the physical letter on Tuesday but no card yet. Any body in the same boat? (I understand that it takes about 1-3 weeks but many have received cards with in a week)
The reason I am asking is my I9 expires month end and HR is on my back for the updated doc. They would rather see a card than a letter which has no expiration date :)

Guys,
I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?

Thank you for the response. I guess one more follow up question. Since I already have an H1B stamping (visa) in my passport that is valid until September 2011 (which lists Company A as my employer). If Company B were to successfully apply for a transfer from B2 to H1B, if I travelled outside the USA, could I still return to the USA with my old H1B stamping in my passport or would I have to go to a US Consulate and get another H1B stamp (visa) that lists my new company?

I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?

You cannot get a VISA stamp earlier than within 20 days of the start date (I actually do not recall if it is 20 days or 15 days -- but it is around that many days).

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?
The EAD is a benefit of being in AOS --- i.e., due to pending I-485 approval. When your I-485 (I-485 applications are individual applications) was denied, your EAD stopped being valid. If you did not stop working, then you were working illegally (assuming that you had no other work VISA). So you have been out of status for more than 2 years, and possibly accrued unlawful presence for a similar period as well. If your unlawful presence accumulated to 180 days, that will trigger a 3 year ban from entering US, and a 10 year ban if the unlawful presence is 1 year or more.

USCIS recently issued a Memo that amends Adjudicator�s Field Manual on General Form I-140 Issues. Many issues are covered, but one of particular interest to our PERM (http://www.h1b.biz/lawyer-attorney-1135851.html)readers is the Labor Certification Validity for Labor Certifications with an Ending Validity Date that Falls on a Saturday, Sunday or Federal Legal Holiday.
DOL has established a 180-day validity period for approved labor certifications. See 20 CFR 656.30(b). An approved labor certification must be filed in support of a Form 1-140 petition during the labor certification's validity period. DOL has not published any guidance regarding the treatment of labor certifications that effectively have a validity period of less than 180 days due to an ending validity date that falls on a Saturday, Sunday, or a federal legal holiday.

I would like to know if i can file multiple 485s being primary on both ?
Here is my current status ...
1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)
So my question is can i have two 485s filed ?
First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.
I am confused, what to do now.
Any advice is appreciated.

Hi,
Last year my husband got laid off. At that time he was on H1 visa, 140 approved and 485 pending. He applied and got AP, and then left U.S in March 2009. AP is valid until March 02, 2010.
Now he wants to get back to U.S. and try his luck finding a job before AP expires.
My question is what are his chances to be able to get in U.S considering
1)He has stayed outside of U.S for about 11 months.
2)He is not employed by any U.S company.
